Project Description
Proposal for alternative solution for 88 Queen Fitzrovia Inc. and Ontari Holdings Ltd. (collectively, the "Owner") is entering into a limiting distance agreement, as permitted by Sentence 3.2.3.1.(11) of the 2012 Ontario Building Code (OBC, O.Reg. 332/12 as amended to O.Reg. 88/19- i.e., Code of record), between its property at 30 Mutual Street with the adjacent property to the north (77 Shuter Street) so as to set a spatial separation line between the two buildings. Due to the complexity of the ownership arrangement of the condominium buildings / lands forming a portion of the limiting distance area, in lieu of utilizing a 'registration on title' legal mechanism (as recognized by OBC Clause 3.2.3.1.(11 )(b) for limiting distance agreements), it is herein proposed to use alternative legal instruments to ensure the enforceability of the limiting distance agreement in favour of the City. This correspondence has been prepared with respect to the fire and life safety requirements in Part 3 of the 2012 Ontario Building Code as well as the Alternative Solution Proposal requirements in Division C, Article 2.1.1.1 of the OBC.
